Last month a video featuring Eric Dane, 36, and his wife Rebecca Gayheart, 38, making out appeared in a blog on Defamer – and the couple went to court to get the parent company’s hide! The 12-minute home video where husband and wife “were partially and sometimes fully disrobed” was recorded in the bedroom of Kari Ann Peniche, former teen beauty queen. Now this video, whatever its entertainment worth may be, is going to cost Gawker Media, sued for copyright infringement, a sum exceeding $1 million dollars.
The lawsuit drawn by Marty Singer, lawyer for Eric Dane, states that Gawker proceeded to distribute an uncensored copy of the video via Defamer’s com willfully in spite of its having been warned that it will constitute a violation of the couple’s legal and privacy rights.
A Twitter message of Nick Denton, Gawker’s publisher, said: “To quote the great Marty Singer, if you don’t want a sex tape on the internet, ‘don’t make one!'”
For the time being there are no comments from Marty Singer or from Dane’s publicist.
